TRELEGY ELLIPTA (fluticasone furoate, umeclidinium, and vilanterol inhalation powder) MOBILE PROGRAM TERMS

1. By opting in to the TRELEGY (fluticasone furoate, umeclidinium, and vilanterol inhalation powder) Mobile Savings Program (the “Program”), in which you consent to receive approximately 10 text messages and/or push notifications per month from EngagedMedia using autodialer technology (including text messages). Consent is not a condition of purchase. Such messages may be marketing or non-marketing messages and may include, for example, refill reminders, fill confirmation, website information, etc. Carriers are NOT liable for delayed or undelivered messages.

 

2. To stop receiving text messages, text STOP to 267-89 or the short code from which you received a message. DOING SO WILL ONLY OPT YOU OUT OF THE TRELEGY (fluticasone furoate, umeclidinium, and vilanterol inhalation powder) MOBILE PROGRAM; you will remain opted in to any other GSK text message program(s) to which you separately opted in. If enrolled in push notifications, you may unsubscribe at any time by going into the digital wallet on your device and disabling push notifications in the digital wallet Program pass or by removing the digital wallet Program pass from your device.

4. By opting in to the Program, you also agree to sharing your phone number with EngagedMedia for the purpose of enrolling you into the text program.

 

5. You represent that you are the account holder for the mobile telephone number(s) that you provide to opt in to the texting program. You are responsible for notifying GSK immediately if you change your mobile telephone number. You may notify GSK of a number change by re-enrolling in the program.

 

6. Message and data rates may apply to each text message sent or received in connection with the texting program, as provided in your mobile telephone service rate plan, in addition to any applicable roaming charges. Charges are both billed and payable to your mobile service provider or deducted from your prepaid account. GSK does not impose a separate fee for sending text messages.

 

7. Data obtained from you in connection with the Program may include your telephone number; your carrier's name; and the date, time, content of your messages, and device information. This data may be used to administer the Program. Please read our full Privacy Policy, which is incorporated by reference into these Terms and Conditions.

 

8. In addition to the data use practices described in the Privacy Policy, GSK may send you offer-related push notifications when your device is in the physical proximity of your pharmacy or healthcare provider. This is done through geofencing technology, which is built in to your device. Your device’s location will not be known or tracked by GSK or its service providers. Nonetheless, you may opt out of geofencing and receiving these notifications at any time by (1) disabling location services for your digital wallet app in your device’s settings, (2) disabling notifications (i.e., automatic updates) within the digital wallet app, or (3) removing the eCard from your digital wallet by selecting “Remove Pass” within the digital wallet app.

 

9. Neither GSK nor EngagedMedia will be liable for any delays in the receipt of any SMS messages, as delivery is subject to effective transmission from your network operator.

 

10. This service is available only on US participating mobile carriers.

 

11. You agree to indemnify GSK and EngagedMedia in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify us if you change your telephone number, including but not limited to all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.

 

12. NO CLASS ACTIONS: you may only bring individual claims. Under no circumstance are you allowed to bring a claim as a punitive or named plaintiff or a class member in a class. Class action lawsuits, class-wide arbitrations, private attorney-general actions, and any other proceedings where someone acts in a representative capacity are not allowed. Any combining of individual proceedings must have the consent of all parties.

 

13. GSK may suspend or terminate your receipt of text messages if it believes you are in breach of these Terms and Conditions. Your receipt of text messages is also subject to termination in the event that your mobile telephone service terminates or lapses. GSK reserves the right to modify or discontinue, temporarily or permanently, all or any part of the text messaging services you receive, with or without notice.

 

14. GSK may revise, modify, or amend these Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect when it is posted to GSK’s website. You agree to review these Terms and Conditions periodically to ensure that you are aware of any changes. Your continued consent to receive text messages will indicate your acceptance of those changes.

 

SAVINGS OFFER TERMS AND CONDITIONS

 

ELIGIBILITY: Patients may be eligible for this offer if they have commercial insurance and insurance does not cover the full cost of the prescription. Patients are not eligible for this program if they are covered by any federal or state prescription insurance program. This includes patients enrolled in Medicare Part B, Medicare Part D, Medicaid, Medigap, Veterans Affairs (VA), Department of Defense (DoD) programs or TRICARE. This may also include state pharmaceutical assistance programs and other federal or state plans not listed. Patients are also ineligible for this program if they are Medicare eligible and enrolled in an employer-sponsored group waiver health plan or government subsidized prescription drug benefit program for retirees. Patients enrolled in private indemnity or HMO insurance plans that reimburse them for the entire cost of their prescription drugs are also not eligible. This offer is not health insurance and is restricted to residents of the United States, Puerto Rico, and US territories. Void where prohibited by law, taxed, or restricted.

 

TERMS OF USE: Eligible commercially insured/covered patients with no restrictions (step edit, prior authorization, or NDC block) and with a valid prescription for TRELEGY (fluticasone furoate, umeclidinium, and vilanterol inhalation powder) who present this savings card at participating pharmacies will pay as little as $0 for each covered 30-, 60-, or 90- day supply (1-3 inhalers), subject to a maximum savings limit of wholesale acquisition cost less $35. Patients are responsible for any additional pharmacy fees and/or charges; patient’s out-of-pocket cost (the amount paid after insurance deductions) if any, may vary. This offer is valid for up to 12 uses, and each 30-day supply counts as 1 use. Other restrictions may apply. Patient is responsible for applicable taxes, if any. This offer is limited to 1 per person and is nontransferable and cannot be combined with any other coupon, free trial, or similar offer. No substitutions are permitted. Patients, pharmacists, and prescribers cannot seek reimbursement from health insurance or any third party for any part of the amount received by the patient through this offer.
